TERMS AND CONDITIONS

Below are our Terms and conditions. Please read them and get in contact if you require clarification.

Cancellations
Due to the nature of our business and that we only work with small groups, cancellations affect us significantly and we apply a strict non-negotiable cancellation policy. We strongly recommend that you have travel insurance which covers all potential cancellation circumstances. A confirmed booking means that you and all members of your group have read, understood and accepted the conditions of our cancellation policy.

Auckland Sea Kayaks reserves the right to cancel or amend any tour due to road, water or weather conditions. If we have to cancel a tour due to such circumstances, you will receive a full refund. If the tour has started the tour can be changed due to safety requirements at the guide’s discretion.

Terms and conditions for cancellations made by us or you.

CANCELLATIONS/AMENDMENTS BY YOU
Bookings cancelled within 48-hours of scheduled departure time are non-refundable. Participants that fail to present themselves at the time of their booking (a no show) will forfeit 100% of their payment.

For day and 1/2 day tours bookings cancelled more than 48-hours before scheduled departure time are subject to a $25 cancellation charge per person and the balance shall be refunded.

For multi-day tours bookings cancelled more than 7 days before scheduled departure time are subject to a $50 cancellation charge per person and the balance shall be refunded.

If you have booked through an agent, third party booking site or discount website, the terms and conditions specific to these booking platforms will need to be adhered to. Auckland Sea Kayaks cancellation policy is only valid for those who booked directly through Go Orange. This is  through the Auckland Sea Kayaks website.

All transactions are conducted in New Zealand Dollars (NZD). Due to exchange rate fluctuations, at times there may be some variance in the amounts refunded compared to the amount initially charged. Auckland Sea Kayaks does not accept any liability for these variances or any subsequent credit card/bank charges relating to these transfers to customer’s accounts.

CANCELLATIONS BY US

For the safety of our participants, due to inclement weather or due to events beyond our control we may need to cancel a tour. We will use all reasonable endeavors to contact the Participant in sufficient time to notify of the cancellation. In the event that we cancel a tour the Participant will be offered either a full refund or a booking transfer to an alternative date and/or time. Auckland Sea Kayaks is not liable in any circumstances for any costs incurred by the Participant as a result of such a cancellation.

These terms are subject to rights and remedies you have under the Consumer Guarantees Act 2003.

You will receive no refund:

1. Cancellations within 48 hours for any reason are non-refundable.

2. If you miss the tour departure (e.g. sleeping late, unexpected illness or injury, vehicle breakdowns, etc);

3. If you do not turn up;

4. If we have to cancel the booking because of client unsuitability due to intoxication.

Risk Disclosure
Sea kayaking and camping have inherent risks and can be dangerous. Detailed risk management and strict safety procedures are observed; however there still remains an element of risk.
Auckland Sea Kayaks cannot absolutely guarantee participants’ safety. Auckland Sea Kayaks accepts its legal responsibilities but cannot be held responsible for personal injury or for loss, theft or damage of/to your equipment outside legal responsibilities. Participants will be required to sign a liability form to this effect before starting a tour.
Changing conditions can mean that tours have to be modified. No two tours are the same. It is very rare but weather could delay your scheduled return by up to 24 hours, e.g. weather conditions preventing kayaking.
Clients on guided tours must listen carefully to and follow guides’ instructions and adhere to safety requirements. Our reputation depends on your safety – we give it top priority and take it seriously. A comprehensive paddling and safety briefing is given before all tours depart. The guided trips also feature friendly on the water paddling instruction, safety management and natural history interpretation. We aim to teach you new skills and to help you have a great time out there, It’s an awesome place and we do our best to ensure our approach to safety reflects our respect for it.

Any concerns should be discussed when you enquire about or before you book a tour. If you want help on which trip is appropriate for you, please contact us.

Restrictions
Although we try and be as inclusive as possible it is important to remember safety is our number one priority. The guide must be able to lift/ assist a client back into a kayak if in the unlikely event that they capsize.

Clients must be made aware that they are required to in a kayak and paddle for up to 90 minutes without the possibility of getting out / stretching or take long breaks.

Our tours are in English and clients must be able to speak and understand English.
